Notice of Adoption of Official Plan Amendment No. 2

Take Notice that on September 7, 2022, the Council of the Corporation of the County of Essex passed By-law No. 2022-27, under Sections 17 and 21 of the Planning Act, R.S.O. 1990, which provided for the adoption of Official Plan Amendment No. 2.

Purpose and Effect

The purpose of Official Plan Amendment No. 2 is to amend mapping on Schedule E1 of the County’s Official Plan to include additional lands within the Mineral Aggregate Resources Overlay as identified by the Ministry of Northern Development and Mines mapping of Selected Sand and Gravel Resource Areas, Essex County. The amendment will recognize mineral extraction on an existing licensed and operating sand pit known as the Mainyard/Woolatt Pit and permit the expansion of their operations to a new sand pit referred to as the MOS Pit.

A copy of Official Plan Amendment No. 2 is available for public inspection in the Clerk’s Office, County of Essex, 360 Fairview Avenue West, Essex, ON, N8M 1Y6 between the hours of 9 a.m. and 4:30 p.m. and on the County’s website. Appeal to the Ontario Land Tribunal in respect of By-law No. 2022-27 may be completed by filing with the Clerk of the County of Essex not later than September 29, 2022 a notice of appeal setting out the objection to the by-law and the reasons in support of the objection accompanied by the required fee (certified cheque or money order) made payable to the Minister of Finance. Upon receipt, the notice of appeal as detailed above, a copy of the appeal form, which is available from the Ontario Land Tribunal website and other documents from the application file will be forwarded to the Ontario Land Tribunal.

The proposed official plan amendment is exempt from approval by the Ministry of Municipal Affairs and Housing. The decision of the council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the County of Essex to the Ontario Land Tribunal, formally the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, formally the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
